We argue that we’re likely to succeed on the merits of our libel claim, and that failure to enjoin the speech would cause us irreparable harm. Too bad, the court will certainly say; a content-based preliminary injunction of speech would be a blatantly unconstitutional prior restraint. Maybe after a trial on the merits and a judicial finding that the speech is in fact constitutionally unprotected libel, we could get a permanent injunction, though even that’s not clear. Likewise for preliminary injunctions against obscenity and other kinds of speech, despite the fact that such speech, if ultimately found to be unprotected at trial, could be criminally or civilly punished. How can this be? True, the Supreme Court has held that copyright law is a constitutionally permissible speech restriction; though copyright law restricts what we can write or record or perform, the First Amendment doesn’t protect copyright-infringing speech against such a restraint. The “First Amendment due process” 4 rule against prior restraints applies even to speech that’s alleged to be constitutionally unprotected. Why, then, not to allegedly infringing speech? In Part I, we discuss the history of preliminary injunctions in copyright cases and the current law relating to such injunctions.

He grew up in a musical household, where everyone loved to sing. Bill expanded his musical horizons both through listening to the radio and through borrowing records from his two older sisters. From high school onward, Bill either had a band to play with or was looking for one. This endeavor took him to Berklee College of Music in Boston where he studied voice, and back to New Jersey where he would commute to work in New York, and eventually down to Austin, Texas.

Though there were a few more moves after his first visit to Austin, he settled there for good in

Sally Abed, Alexandria University, Egypt: Female Performers between Reality and Fiction In this paper, I briefly examine the under-investigated role of female performers in public spheres in medieval Arab culture and use this historical perspective as a segue to the One Thousand and One Nights. I approach the Nights through the performance lens, which I use to investigate the voice of Dinarzad, Scheherazade’s sister, and its role in structuring the tales.

Most scholars focus on the dominant voice of Scheherazade and leave out that of Dinarzad since she seems to be outside the hegemonic power structure of the tales. It is the “subaltern” voice that contributes to weaving the tales and promoting female agency. Both sisters stage a unique performance that moves subtly from leisure and pleasure to politics. Therefore, I aim to study the multivalent significance of Dinarzad’s voice and her position as a dominant ‘other’ both textually and visually.

The position of Dunyazad in the text is both literal as she hides underneath the royal bed as well as metaphorical. Both positions beg for a different interpretation of structuring and performing the female voice in the tales. In Iceland between the 9th and 13th century horses were used for transportation, fighting, worship, food and as pack animals.

Unlike the rest of Europe at the time, Icelandic horses also provided a source of entertainment.

VALUABLE RESOURCES NOT TO BE IGNORED

The world that Adam and Eve entered after their expulsion from the garden of Eden could not have been more different from the perfect environment they had so recently taken for granted. Instead of abundant prosperity, ready at hand, they had entered a world of limitation, shortage and scarcity. Instead of a world where all their needs were instantly provided for without any effort on their part, back-breaking toil was now necessary for survival, and uncertainty for the future entered into the equation.

Life was now a matter of pain, sweat, tears and trouble. Our first parents would also now experience for the first time the full gamut of destructive and sinful emotions, including fear, jealousy and hostility.

Yale University Press, Contains “Select Bibliography” pp. The catalogue also discusses many other prints from Hogarth’s picture series. Foreword by James Cuno; Introduction, pp. This page catalogue throws new light upon Hogarth’s Sigismunda , considering the painting in the context of contemporary debates about female sexual desire, luxury consumption, and the modernity of English art.

Princeton University Press; London: Tate Gallery Publishing Ltd , The author in desiring not to write a chronological life-story of Hogarth has chosen a series of thematic essays “each devoted to an aspect of the social and cultural history of the period”. The book reveals Hogarth as an English nationalist and as a figure who reinvented the very idea of what it is to be an artist.

It also sees him as a humourist who brilliantly invented a means of reproducing wit for wider public consumption. The study shows that Hogarth’s works were aimed at fostering self-improvement, whereby vice can ruin the aristocrat as swiftly as the harlot, but does so with great humour. We meet an artist emblematic of his time but also ultimately innovative and long-sighted.

This is not the view that will be taken in this article. Time-out is of course as venerable an institution as work itself. But leisure has certain traits that are characteristic only of the civilization born from the industrial revolution. In the earliest known societies, work and play alike formed part of the ritual by which men sought communion with the ancestral spirits.

The room would most likely have contained a central mahogany dining table (perhaps of gate-leg design, so that it might be folded and placed against the wall when not in use), with upholstered and carved mahogany dining chairs, and perhaps a small mahogany sideboard.

Theories of humour Many theories exist about what humour is and what social function it serves. The prevailing types of theories attempting to account for the existence of humour include psychological theories, the vast majority of which consider humour-induced behaviour to be very healthy; spiritual theories, which may, for instance, consider humour to be a “gift from God”; and theories which consider humour to be an unexplainable mystery, very much like a mystical experience.

The theory says ‘humour only occurs when something seems wrong, unsettling, or threatening, but simultaneously seems okay, acceptable or safe’. Others believe that ‘the appropriate use of humour can facilitate social interactions’. Views[ edit ] Some claim that humour cannot or should not be explained. White once said, “Humor can be dissected as a frog can, but the thing dies in the process and the innards are discouraging to any but the pure scientific mind.

This process of dissecting humour does not necessarily banish a sense of humour but begs attention towards its politics and assumed universality Khanduri However, both humour and comic are often used when theorising about the subject. The connotations of humour as opposed to comic are said to be that of response versus stimulus. Additionally, humour was thought to include a combination of ridiculousness and wit in an individual; the paradigmatic case being Shakespeare’s Sir John Falstaff.

The French were slow to adopt the term humour; in French, humeur and humour are still two different words, the former referring to a person’s mood or to the archaic concept of the four humours.

According to those proposing a change in terminology, “slave” perpetuates the crime of slavery in language, by reducing its victims to a nonhuman noun instead of, according to Andi Cumbo-Floyd, “carry[ing] them forward as people, not the property that they were”. Other historians prefer “slave” because the term is familiar and shorter, or because it accurately reflects the inhumanity of slavery, with “person” implying a degree of autonomy that slavery does not allow for.

A Meccan merchant right and his Circassian slave, between and Chattel slavery Chattel slavery, also called traditional slavery, is so named because people are treated as the chattel personal property of the owner and are bought and sold as commodities.

Examples of sexual slavery, often in military contexts, include detention in “rape camps” or “comfort stations,” “comfort women”, forced “marriages” to soldiers and other practices involving the treatment of women or men as chattel and, as such, violations of the peremptory norm prohibiting slavery.
